A Planning Aplication [Ref CM8/899/44] was submitted by UK Coal plc in December 2002 to Derbyshire County Council requesting planning permission to open cast mine and restore their Shipley West site - an area of 163 acres [66 hectares] of Green Belt land.  The proposed site lies within both the Erewash and Amber Valley areas, lying to the west of Ilkeston, north of West Hallam and east of Mapperley.

 

The minimum estimated duration of this project was 26 months.  WHEG submitted an extensive [48 page] objection document to DCC, strongly opposing the application on the basis of a number of key areas/issues and emphasizing that approval of this application would be:

 

  • A breach of Government and Local Planning policy guidelines
  • A breach of law to damage or destroy habitat - Schedule 5 of the Countryside Act 1988
  • A dereliction of duty of care on the part of Derbyshire County Council to protect the health and well being of the community
  • Possibly open to challenge under the Human Rights Act 1998 - "Right to Life"

 

Since the objection document was submitted to DCC on 7th July 2003, planning approval was denied and the appellant decided not to take the planning application to Appeal.

Derbyshire County Council have advertised an open invitation to purchase and develop the leasehold site now known as Shipley Lakeside.

 

There are three bids on the table at present; an educational establishment to include playing fields, visitor attractions including adventure playground etc and a mixture of business park, educational, healthcare etc
